icabezudo, the breach doesn't necessarily have to do with powerleveling in particular.

For example if you were to have someone powerlevel your character their is most likely (i haven't studied blizzards but have done for many others) a clause that states you are the only person allowed to play your account and nobody else.
They would further state the 'other person' is not agreeing to the eula because they are not paying a fee for that monthly subscription as you pay to use your specific account, not to use anyone elses account (and not agreeing to the eula is also a breach of the eula)

I'm not saying this is the wrong/right thing for blizzard to do but merely giving you a reference of what to look for.

Yes, they are made by BLIZZARD but we are PAYING blizzard to USE the items, even though we aren't exackly paying them directly for the specific item. They invent the items and put them into the random loot table, where random items can drop from any mob. Its our game time that we are using to get these items, so we are technically paying for the items already by using our real life money to pay the company to allow us to find these items, so technically they are our items now, not theirs.
Yes, they have the ability to create these items, when they are not in anyones possession then they are their items, but if someone finds them, the items then become owned by the person who found the items, as we pay the company.

So since the items are actually our property even though they are inside a companies space, we pay the company to create these items and put them into loot tables, but as soon as we find them, they are our items.
So, in my opinion, I believe they should be allowed to sell these items, since we have paid for them and since we have paid for them, blizzard no longer owns them.
You ever have a membership to a gym? You PAY to go there and USE their equipment, doesn't mean you can sell the item.

Is it illegal to buy the items? ;)

I mean, you can't sell gold for instant, but if I'm correct it isn't forbidden to buy?

You can buy and sell... Just don't get caught. It's not illegal and saying you will go to jail, but you may lose your account.
