I've been told "ban" means they deleted your account and that its under the TOS agreement. I've never read it so I won't say I saw it though ^^
I do know that its near impossible to prove you were using a third party program, unless they target your account. Even then, that is not enough evidence to convict someone of a crime. Just because they run a scan on processes running under your game (which is illegal without your concent) or see you fleeing across a wide area, doesn't mean that the information transcieved between the two points was not misread or missent ... or even lagged. Software is not perfect and cannot be used to convict someone of wrong doing unless the evidence is overwhelming. Which is the reason MMORPG's don't open lawsuits against people "damaging their online gaming" industry unless they are a major role player in that area of hacking; such as, distrobuting a hack or using it to damage their servers.
I'm sure it says something in the TOS along these lines though ... "We can terminate your membership just because we feel like it and we need not provide a reason."

some irony in this area. One of the people I work withs' son, got a speeding ticket for doing something like 130 in a 40. To the cop, regardless of what the radar gun said, it was obvious he was speeding. His dad, being one of our oldest engineers here at work, decided to order the skemetics for that specific model of radar gun used and research the components a little. If you have ever heard the phrase, "chain is only as strong as its weakest link" ... the same goes for electronics. If you use a lower end component (something that has a low tollerance such as a 20% resistor) it compromises your entire circuit. This guy was able to convince the judge that because the tollerance of the weakest component was so large, the gun could not be that accurate ... especially at higher speeds. His ticket was not dropped ... but lowered by the largest margin of error on the components allowed
