If you purchased the account from someone you're SOL.
The only way to completely buy someone else account and keep it, is if you...
1) Call Blizzard and have them change ALL the info. This includes the original name, and email. You will need to explain why you need the name changed IN DETAIL, over the phone. When requesting this, do not EVER say "my friend is giving me the account", or anything along those lines. Tell them you're having your legal name changed. And no, I'm not joking. Sure they will think it's BS, but if you request the info change with "My friend can't pay for the account anymore" ect. they will tag the account, and a GM with send you an email requesting some of the following information. If you can't come up with the info, your account may be suspended indefinately.
2) You need the CD's, as well as the CD box. Blizzard may ask you to send in part of the box, a CD, or a CD sleave.
3) The original purchase recipt. They may ask you for the original purchase recipt. This is mainly for requesting a new CD. Example if you purchased a CD from a store and it was already in use.
4) The secret question answer.
It's good to know a GM IRL ^^
EDIT
Also, if your purchased the account using Paypal, check to see if the period for a Paypal reversal has expired. Many people who do account stealbacks DO wait for this period to end, though some may not.

My friends account was stolen. They requested the first gamecard used on the account, or the most recent one used. On top of that, they needed a certificate of notoriaty (or something). Yeah, he said !@#$%^&* it and got a life.
